1. Returns | top

Store credit or exchange only on all returns. All returns must be shipped within ONE week of receipt. Custom embroidered items are personalized just for you, so, these items are NOT accepted for return or exchange unless we have made a mistake in your embroidery. Your satisfaction is our top priority, but we can not accept returns for reasons like ordering wrong sizes or colors, or if you are not happy with your font choice.

Each letter of our name fonts can be viewed by clicking on the Fonts link at the top of each page. You can view both uppercase and lowercase letters for each font by clicking on the font name. Please be sure to double check spelling of name and/or monogram before placing your order.  If you made a mistake on an order, please call us immediately as some items may go directly into monogramming and once an item is monogrammed, we cannot refund or cancel your purchase due to your spelling errors.  If you would like to see how your name will look in a specific font, please email us and we will be happy to email you a sample back. If you have any questions about an item, PRIOR to ordering, please contact us.

Most items are processed & shipped within 1-3 weeks, usually sooner! Please contact us if you need an order sooner. A rush charge may apply. Please prepare for holidays, special times of year, and seasons accordingly. Our shipping times may vary during back to school time (mid-July through August), Christmas & Hanukah, and may exceed the 3 week delivery time.

Shipping and handling charges are NOT refundable unless the error is due to our mistake. Items returned must be received unworn and unused. Returns are subject to inspection upon arrival and credit is pending approval upon arrival. Embroidered Items that are replaced due to our error, will be replaced exactly as specified on the original order - we will not replace an item in a different color, font, or thread color. Please include a copy of your receipt with your return. We reserve the right to reject any return or exchange that does not meet these criteria. For your protection, on return shipments, please use a carrier who can provide you with a tracking number for your shipment. We are not responsible for return shipments lost or not delivered to us. Please be very careful when sending return shipments.

If an item must be returned due to our error, please contact Customer Service at sales@wsemb.com or call us toll free at (877) 211-4221, Monday through Friday, between 9 a.m. and 5 p.m. EST so that we may assist you in processing the return. Email is our preferred method of communication, and will get the fastest response. Please provide your invoice number in your email as well as a return phone number. We want you to love your Personalized by Design gifts!!

2. Cancelled Orders | top

Orders may be cancelled up until we embroidery the product. For items in stock, there is no cancellation fee. For any items that we have already ordered for you from the manufacturer, there is a 20% restocking fee. We only carry a limited number of products in stock, and generally place manufacturer orders within 24 hours after you place your order with us.

3. Backorders | top

  If an item is on backorder, the entire order will be held until all items are available, unless otherwise requested by customer. Separate shipments will result in additional shipping charges. We will notify you if a backorder situation will result in unreasonable completion times.

4. Shipping | top

When shipping is involved, we will ship the items as soon as they are completed. Choosing Express Delivery does not necessarily mean you will receive your item the next day. Time is needed to custom embroider your item(s) before shipping. If an item is needed right away, please call to confirm availability, and time needed to customize.

Any damages caused in transit will be the responsibility of the carrier and should be reported to them immediately.

5. Phone Orders | top

We prefer for you to place your orders through our website. If you are having computer issues and cannot place your order this way, you can call us at 877-211-4221, and we will take your order over the phone and enter it into our website in the same manner. After taking your phone order, you should receive an email confirmation. It is your responsibility to review your order and check for any mistakes. If there is a mistake in your order, you MUST notify us immediately. We are not responsible for mistakes made entering phone orders.

6. Taxes | top

Purchaser agrees to pay or reimburse Seller for any sales, excise or other tax levied by any governmental agency, state or local tariff which is accessed against his purchase of goods or merchandise.

While Winterscapes Embroidery may not charge taxes in all states, purchasers in those states may be required by their state law to pay taxes on purchases from Winterscapes Embroidery.

7. Payment | top

Credit cards – We accept Visa, MasterCard, or Discover.
PayPal - We accept PayPal for online orders only. Online order confirmation emails are sent BEFORE PayPal payment is completed. If you cancel the PayPal payment process, or if payment is unsuccessful, your order will automatically be cancelled.
Personal/Business Checks - We will accept personal/business checks. A $35.00 service charge will be assessed on all returned checks.

8. Usage Conditions | top

You agree to access and use this site only in accordance with this usage policy. Any conduct by you, which in our sole discretion restricts, inhibits or otherwise interferes with any other user in using or enjoying the site, will not be permitted. You agree to use the site only for lawful purposes and to refrain from posting on or transmitting through the site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, fraudulent, racially, ethnically, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or other wise violate any applicable local, state national, or international law.

You agree not to access the site by any means other than through the web interface that is provided by us for use in accessing the site. You agree you will not attempt to defeat, disable or evade any security measures or access restrictions that may be in use in connection with the site nor to use or access the site in excess or outside your authorization to do so.

You acknowledge that the site contains information, data, images and other material (collectively “Content”) that are protected, individually and collectively, by copyright, trademark, or other proprietary right of the company or third parties. You may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the content, in whole or in part, except as expressly allowed in this Use Policy or U.S. Copyright law. If no specific restrictions are displayed, you may make copies of select portions of the content, provided that the copies are made only for your personal information and non-commercial use and that you do not alter or modify the content in any way. 9. Governing Law | top

We reserve the right to modify these Terms & Conditions at any time by posting the modified Terms & Conditions on this site. The modified Terms & Conditions will be applicable to your access to the Site, and to any orders placed after such posting. Our failure to exercise or enforce any right or provision of these Terms & Conditions on any occasion shall not constitute a waiver of such right or provision on any other occasion. These Terms & Conditions, any dispute about an order placed or goods obtained through the site and your use of the site will be governed by the law of the State of New Jersey, without regard to its conflict of laws principles. If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid, all other provision will remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action that you or anyone claiming through you may make, arising out of or related to use of the site or order placed through the site, must be filed within one year after such claim or cause of action arose or be forever barred.
